These terms govern your use of this website. By browsing the site or submitting a form on it, you agree to them. If you become a client, your training is governed by the separate agreements you sign, described in section 4.
1. About Amplify
This website is operated by APT Randolph, LLC, doing business as Amplify Personal Training ("Amplify," "we," "us"), a small-group personal training studio at 389 Dover Chester Road, Lower Level Unit #2, Randolph, NJ 07869.
The site exists to explain how we train, who we work with, and how to request a consultation. It is a source of information and a way to get in touch, not a place to purchase or book training.
2. Website information
Everything on this site is general information about our services. Details such as programs, schedules, availability, and pricing may change without notice, and we do not warrant that all content is complete or current at all times.
Nothing on this site is medical, physical therapy, nutritional, or diagnostic advice, and it is not a substitute for consulting a qualified healthcare provider. Nothing on this site is a guarantee of any particular result. Individual outcomes depend on factors we do not control, including your health, effort, consistency, and history.
3. Consultations and inquiries
Submitting the consultation form is a request to be contacted. It does not create a membership, reserve a spot in a group, or guarantee that an appointment will be available.
We will follow up to schedule a consultation call when we can. Consultations are free and carry no obligation to join. We may decline or discontinue an inquiry at our discretion, including where we do not believe we are the right fit for someone's goals or needs.
4. Memberships and training
These website terms do not govern training itself. If you join Amplify, your relationship with us is governed by the documents you sign at sign-up, which may include a Membership Agreement, a participation agreement and waiver and release of liability, a health history and clearance form, and studio policies.
Those signed documents control all matters relating to your training, including rates, billing and renewal, cancellations and missed sessions, holds, assumption of risk, and termination. Where anything in these website terms conflicts with them, the signed documents control.
5. Intellectual property
The Amplify name, logo, and brand marks, and the text, photography, layout, and design of this website are owned by us or used with permission. The training programs, assessments, and materials we create for clients are also our property.
You may view and share this site for personal, non-commercial purposes. You may not copy, reproduce, republish, resell, or coach from our content, programs, or materials, or use our name or marks, without our written permission.
6. Acceptable website use
You agree not to:
- Interfere with, disrupt, or attempt to gain unauthorized access to the site or its underlying systems.
- Scrape, crawl, or harvest content or data from the site by automated means, or use it to train a machine learning model, without our written permission.
- Submit false, misleading, or unauthorized information through our forms, or impersonate another person or use someone else's contact details.
- Submit spam, malware, or unlawful, abusive, or harassing content.
- Use the site for any purpose that violates applicable law.
We may restrict or block access to the site for conduct that violates these terms.
7. Third-party services
This site relies on third-party services to function, which may include web hosting, form and email delivery, scheduling, payment processing, analytics, and social media platforms such as Instagram and Facebook.
Those services operate under their own terms and privacy practices, and we do not control them. Links to third-party sites are provided for convenience and are not an endorsement. We are not responsible for the content, availability, or practices of any third-party service.
8. Website disclaimer and limitation of liability
This site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Amplify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of your use of this site. Our total liability relating to this website will not exceed one hundred dollars ($100). Nothing here limits liability for gross negligence, willful misconduct, or anything else that cannot lawfully be limited, and nothing here limits or replaces the liability terms in any agreement you sign as a client.
9. Privacy
Information you submit through this site is handled as described in our Privacy Policy, which explains what we collect, how we use it, when we send marketing communications, and the choices you have. The Privacy Policy is part of these terms.
10. Governing law and disputes
These terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules.
Any dispute arising out of or relating to these terms or this website will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Morris County, New Jersey, or by videoconference or telephone, and the award may be entered as a judgment in any court of competent jurisdiction.
Arbitration will proceed on an individual basis only. You and Amplify each waive the right to a jury trial and the right to bring or participate in a class, collective, or representative action. Either party may still bring a qualifying individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized access to our systems.
You may opt out of this arbitration provision by emailing info@amplifypersonaltraining.com within 30 days of first agreeing to these terms, stating your name and your intent to opt out. Opting out does not affect any other part of these terms.
11. Changes to these terms
We may update these terms as our services or the site change. The current version will always be posted on this page with a new "last updated" date, and it applies to use of the site after it is posted. If you continue using the site after a change, you accept the revised terms.
